WHEREAS Section 11(3)(1) of the Municipal Act, 2001, S.O. 2001, c. 25 as amended, provides Council the authority to enact by-laws to regulate parking and traffic subject to the Highway Traffic Act;

 

AND WHEREAS Council deems it expedient to amend By-law No. 03-62 to amend no parking and stopping areas within the Town of Collingwood;

 

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD HEREBY ENACTS AS FOLLOWS:

 

1. THAT Schedule “A” of By-law No. 03-62, being a schedule depicting No Parking Areas within the Town of Collingwood be hereby deleted and replaced with Schedules “A” and “D” as attached.

 

2. THAT the following be added to Part III:

 

(F) No Stopping Zones

The highways as set out in Schedule “D” attached hereto shall be deemed no stopping zones and no stopping shall be permitted in the areas described therein.

 

3. THAT the following be deleted from Part III (C) - Bus and Taxicab Stands:

 

“except that the driver of a passenger vehicle may temporarily stop therein for the purpose of and while actually engaged in loading or unloading goods or passengers when such stopping does not interfere with any bus or taxicab waiting to enter such zone”

 

4. THAT Part III(D) – Bus Stop be hereby deleted and replaced with the following:

 

“bus stop” means the portion of a highway abutting the curb or boulevard, indicated by a posted authorized sign for the purpose of stopping buses operated by the Town of Collingwood while picking up or discharging passengers;

 

For the purpose of Part III(A)(1)(q), a vehicle shall be deemed “parked at a bus stop” when the vehicle is parked within 15 metres of the posted authorized sign. A Municipal By-law Enforcement Officer or Police Officer may cause the vehicle to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, shall be the responsibility of the vehicle owner and maybe enforced in the manner provided by theRepair and Storage Liens Act.

 

5. THAT this By-law shall come into full force and effect on the date of final passage hereof at which time all By-laws and/or resolutions that are inconsistent with the provisions of this By-law and the same are hereby repealed or rescinded insofar as it is necessary to give effect to the provisions of this By-law.
