Summary:
BEING A BY-LAW TO AUTHORIZE THE CONSTRUCTION OF SANITARY SEWER AND WATER SERVICES AND UNDERTAKE SUCH WORK AS A LOCAL IMPROVEMENT
WHEREAS the owners of properties abutting Raglan Street between Hume Street and Ron Emo Road and Hume Street between Raglan Street and Pretty River Parkway South, as set out
in Schedule A attached hereto, have petitioned for construction of a sanitary sewer, sanitary sewer and water services, or water services, as applicable, to liable properties, hereinafter referred to as "the Works";
AND WHEREAS theMunicipal Clerk has certified that the petition for undertaking the Works is sufficient pursuant to the requirements set out in Ontario Regulation 586/06 Local Improvement Charges - Priority Lien Status, under the Municipal Act, 2001, hereinafter referred to as "the Regulation";
AND WHEREAS notice of the Municipality’s intention to pass a by-law to undertake the Works as a local improvement at the regular meeting of Council to be held August 8, 2011 was given to the public on June 30, 2011 and to the liable property owners on June 30, 2011, in accordance with section 6 of the Regulation;
AND WHEREAS it is deemed expedient that the actions of all meetings of Council of The Corporation of the Town of Collingwood be confirmed and adopted by by-law;
NOW THEREFORE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:

THAT the Corporation of the Town of Collingwood shall construct the Works at a total estimated cost of $2,873,000.00 (excluding taxes);

THAT the Corporation of the Town of Collingwood shall undertake the Works as a local improvement for the purpose of raising part of the cost of the Works by imposing special charges on lots abutting on the Works and/or immediately benefiting from the works in accordance with the provisions set out in the Regulation;

THAT the Executive Director of Public Works or the consulting engineer for the Town of Collingwood shall take such action as may be necessary for the preparation of a contract or contracts for the execution of the Works under their supervision;

THAT pursuant to the Regulation, the total cost of the Works shall be financed as follows:
a) the owners' share of the estimated cost shall be $701,766.00 being the sum of $325 per actual linear metre of assessable frontage/flankage and where applicable $265 per actual linear metre of assessable frontage/flankage and a mandatory connection fee as set out in the fees and service charges by-law, as set out in Schedule “A” attached hereto; and
b) the Municipality’s share of the estimated cost shall be $2,171,234.00.

THAT this by-law shall come into effect upon the passing thereof.
