Part Lot Control By-law (Blue Fairway)

Summary: 

BEING A BY-LAW TO EXEMPT A PORTION OF LAND FROM THE PART LOT CONTROL PROVISIONS OF THE PLANNING ACT


WHEREAS subsection 50(7) of the Planning Act, R.S.O. 1990 c. P.13, provides that the Council of a local municipality may, by by-law, designate lands not to be subject to part lot control;
 
AND WHEREAS it is intended that eighty-three (83) lots for townhouse dwelling units and a common element condominium consisting of private roads, an amenity area and buffer areas, and be created from a portion of Block 1 on Registered Plan No. 51M-1093;
 
AND WHEREAS the Council of the Town of Collingwood is satisfied that the creation of the eighty-three (83) townhouse lots and common element condominium parcels may proceed;
 
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD ENACTS AS FOLLOWS:
 
1.    THAT subsection 50(5) of the Planning Act, R.S.O. 1990, c. P.13, shall cease to apply to Parts 1 to 235 on Plan 51R-40891, being a portion of Block 1 on Registered Plan 51M-1093, Town of Collingwood, County of Simcoe as shown on Schedule “A” affixed hereto.
 
2.    THAT the configuration of lot lines and parcels shall be in accordance with Plan 51R-40891, as shown on Schedule “B” affixed hereto.  
 
3.    THAT this by-law shall remain in force and effect for a period of two (2) years from the date of its passing and shall expire on April 24th, 2019.
