BEING A BY-LAW TO AUTHORIZE THE EXECUTION OF A SITE PLAN CONTROL AGREEMENT BETWEEN ARO TECHNOLOGIES AND THE CORPORATION OF THE TOWN OF COLLINGWOOD
WHEREAS Section 41 of the Planning Act, R.S.O. 1990, c. P.13, delegates authority to local municipal councils for matters within their jurisdiction for Site Plan Control Approval and to enter into agreements thereunder;
AND WHEREAS a Development Site Plan Agreement subject to the property municipally known as 35 Stewart Road was approved and registered in title under Instrument No. R01148159 and dated January 25, 1990;
AND WHEREAS Council deems is expedient to remove Instrument No. R01148159 and replace the original Development Site Plan Agreement with one application to allow for the expansion of an existing industrial building;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF COLLINGWOOD HEREBY ENACTS AS FOLLOWS:
1. THAT Instrument No. R01148159 registered against PIN58260-0033 be deleted;
2. THAT the Mayor and Clerk be hereby authorized to execute a new Site Plan Control Agreement for the development located on land municipally known as 35 Stewart Road between ARO Technologiesand The Corporation of the Town of Collingwood, affixed hereto as Schedule “A”;
3. THAT this by-law shall come into full force and effect on the date of final passage hereof at which time all by-laws that are inconsistent with the provisions of this by-law and the same are hereby amended insofar as it is necessary to give effect to the provisions of this by-law.
